DCJS releases arrest records as part of criminal history reports, or "rap sheets", in response to inquiries. Individuals who want to request criminal and arrest records from the DCJS can submit a request by scheduling a fingerprint appointment at any DCJS fingerprint enrolment center, or by visiting any law enforcement office with an FBI (FD-258) fingerprint card form and paying the request fee. Potential Employers can use the Criminal Record Information Form to request arrest records. The law enforcement office will then send the request to the DCJS for processing, and the DCJS will mail it to the requester if the request is successful.

Rensselaer County Inmate Locator

Information regarding inmates housed at the Rensselaer County correctional facility is maintained by the county's Bureau of Corrections, a department of the Rensselaer County Sheriff's Office. Active Warrant Search in Rensselaer County

An arrest warrant, or warrant for arrest, per section 120.10 of the New York Criminal Procedure Law, is a procedure document issued by a local criminal court instructing a police officer to apprehend a defendant named in an accusatory affidavit filed with the court and to appear before the court in relation to the document. Warrants are issued by judges in Rensselaer County only when there is probable cause to suggest that an individual is guilty of a crime for which they are accused.

How to Find Arrest Records for Free in Rensselaer County

Individuals can obtain Rensselaer County arrest records for free by submitting Freedom of Information (FOIL) requests in person at any Rensselaer County law enforcement office. To perform a free search, requesters will need to complete a fee waiver records request form at the office and a poverty affidavit to show that they cannot pay the record request fees. Alternatively, individuals can use the public access terminals at Rensselaer County courthouses to look up arrest records from criminal cases handled by the court. However, free arrest records from public access terminals are limited in the information they provide.

How to Get an Arrest Record Expunged in Rensselaer County

New York law only allows automatic expungement for specific low-level misdemeanors like marijuana offenses through the New York Clean Slate Act.

Unlike other states, New York does not have an expungement statute for most arrest and criminal records. However, the law in Newyork allows persons to seal Rensselaer County arrest records. Persons who wish to have their arrest records sealed in Rensselaer County must first determine whether they meet the eligibility criteria set by New York law. Automatic sealing is typically available for arrests that end in a dismissal, acquittal, non-criminal outcome, and some convictions involving marijuana or cannabis. Section 160.59 of the New York Criminal Procedure Law (CPL) stipulates that individuals with two or fewer arrests and convictions may apply to have their records sealed after a ten-year waiting period, provided that the crimes do not include ineligible offenses such as violent felonies, Class A felonies, homicide felonies, sex offenses, sexual performance by a minor offenses, or felonious attempts.

Persons who want to seal their Rensselaer arrest record will need to submit a motion to the court where the case was filed and prosecuted to have it sealed. If the court grants the petition, it will be entered into the record, at which point the Rensselaer County law enforcement offices and courts will seal all records. The District Attorney may, however, contest the petition and hold a hearing at which the petitioner will need to present additional evidence to support the sealing of the record.
